After considering this all day, I don’t see what will be accomplished here.
On the hush-money front: Cohen will assert that Trump illegally influenced the election results by offering hush-money to conceal his affairs . They were consensual relationships with pornstars, not prostitutes, and having an affair isn’ t illegal. Trump is going to say he only paid them off because he did not want the personal embarrassment and his family to know. The second is a very plausible explanation, regardless of whether or not it’s true. Without recorded/written evidence, there’s no way to prove otherwise. I don’t believe it’s illegal to pay hush money to cover up an affair (is it???), and it was paid with personal funds before he was in office.
As for the tax issue, Trump has been audited for decades, and the IRS has never found any criminal activity. He simply cited past losses to cancel out present-day taxes owed, which is enough to warrant an IRS audit, but not illegal. The only thing I can think of is that he falsified the value of his commercial properties to avoid paying taxes; If I recall correctly, you self-report commercial real estate values, unlike private residences whose values are determined by the state. The IRS would have to prove that he intentionally falsified his property values. In reality, they would likely just require him to pay the difference or they’ll slap a tax lien on his property. He either pays it, or the relevant entity will auction it off. To my knowledge, none of Trump’s properties were ever served with a tax lien or foreclosed.
Assuming evidence of criminal activity were found and charges were filed, none of it happened while in office, so at most we’re quibbling about him lying about the knowledge of past criminal activity. But even if the House voted to impeach him, it would require a supermajority in the Republican-controlled Senate.
So, yeah, we’re back to square one.
